Fairchild is satiated, Vision tv in pursuit, and TMN-The Movie Network reportedly considering its options after precedent-setting action from the crtc on the cable ‘realignment’ of Chinavision.
Behind a 40-page filing from Goodman Phillips & Vineberg’s Kathryn Robinson, the commission ruled that Rogers Communications’ quest to pull Chinavision into the analog nether-regions was in breach of both section 9(1)(h) of the Broadcasting Act and the Access Rules, and contrary to section 19 of the Cable Television Regulations.
The October directive marks the first time the Access Rules have been leveraged, with crtc secretary general and coo Laura Talbot-Allan making the point that although the rules are not yet regulations, the commission expects all bdus to play as if they were.
‘Contrary to Rogers interpretation, the Access Rules do obligate Rogers to distribute the Fairchild service on a channel available to all subscribers in the licensed area affected.
