Howsam indicted for fraud, false statements

Gary Howsam has been indicted on a bank-fraud charge and six counts of making false statements in a loan document by a federal grand jury in Los Angeles.

The indictment against the former CEO of Peace Arch Entertainment follows an arrest on Nov. 5 and was unveiled Tuesday in Los Angeles by the U.S. Attorney for the Central District of California.

The indictment charges that Howsam falsified contracts with international distributors to secure film financing from Comerica Bank of California for the 2001 movie Going Back.

The grand jury finding follows a three-year probe by the FBI into Howsam’s film-finance dealings with Comerica in 1999 and 2000.

That was before Howsam became CEO of Peace Arch Entertainment in 2003, a position from which he remains on administrative leave following his arrest.

Howsam’s Los Angeles-based lawyer Donald Randolph was not available for comment at press time.

In a related move, the U.S. Attorney’s office okayed Howsam changing his pre-trial residence in Los Angeles from Playa Del Rey to an apartment block in Santa Monica.

Howsam had been staying at the home of a Los Angeles-based Peace Arch executive since Nov. 5. But his lawyer urged that his pretrial residence be changed as there was ‘insufficient space for Mr. Howsam to reside there on a long-term basis.’

Howsam is set for a formal arraignment on Dec. 3, at which time he’s expected to offer a plea.
